Instagram Contest Rules: Holiday Contest, 2022 Edition

Read these “Holiday Contest” (hereinafter referred to as “Contest”) rules in their entirety before entering the Contest.

Do not enter the Contest if you do not agree to these rules. Participation in the Contest constitutes your approval and acceptance of these Contest Rules, which are final in all matters relating to the Contest.

The Contest begins on November 18, 2022 at 9:00 a.m. Montreal time and ends on December 16, 2022 at 1:00 p.m. (hereafter referred to as the “Contest Period”).

Eligibility

1. Only Quebec residents are eligible to enter this Contest. Employees, agents or representatives of the Sponsor, its parents, subsidiaries, affiliates and retailers, its advertising and promotional agencies, its suppliers of prizes, materials or services related to this Contest, and members of their immediate families and persons with whom they are domiciled are not eligible to enter this Contest.

Participation

2. NO PURCHASE IS REQUIRED.
During each phase, a post respective to the phase will be pinned to our Instagram feed (thereafter referred to as “the phase post”).

During the Contest Period, participants may enter the Contest by:

(a) Liking the phase post;

(b) Commenting on the phase post by tagging their favourite Quebec small business;

(c) Sharing the phase post in a story.

Limit of one entry per person per phase of the contest, i.e. 4 entries during the contest period. If it is discovered that you have entered more than once, only your first entry will be included in the draw. Entrants may enter each phase during the Contest Period within the established period.

Prize

3. The prizes are different for each phase of the contest.

Phase 01:

2 draws for a basket valued at $289.25 with the theme “Entrée” including Quebec products:

2 draws for a basket valued at $291 with the theme “Supper” including the following Quebec products:

Phase 03:
2 draws for a basket valued at $302.80 with the theme “Dessert” including the following Quebec products:

Phase 04:
1 grand prize draw, a basket worth $662.80 including all the following Quebec products:

Each winner will be drawn by one or more authorized representatives of Ateliers Jacob (the “Contest Judges”). Prize must be accepted as described in these Contest Rules and cannot be substituted for another prize or exchanged in whole or in part. Refusal by an entrant to accept a prize or any portion thereof forever releases the Sponsor and its agents from any and all obligations related to the prize, including delivery. The prize may not be sold or transferred and is not redeemable for cash.

Winner will be required to provide Ateliers Jacob with a street address for delivery of the prize. A signature will be required upon receipt of the package.

If, for any reason beyond the control of the Sponsor and not related to the winners, the Sponsor is unable to award the prize described in these Contest Rules, the Sponsor will substitute the prize, in whole or in part, with a prize of similar nature and equal or greater value, at its sole discretion.

Limit of one prize per person.

4. Odds of winning the prize vary depending on the total number of eligible entries received by the end of the Contest Period.

5. The prize winner will be selected by random draw:

Phase 01: The Entrée

from November 18, 2022 at 9:00 am to November 25, 2022 at 9:00 am

Drawing on Friday November 25, 2022 at 9:00 am

Phase 02: The Main Meal

from November 25, 2022 at 9:00 am to December 2, 2022 at 9:00 am

Drawing on December 2, 2022 at 9:00 am

Phase 03: The Dessert

from December 2, 2022 at 9:00 am to December 9, 2022 at 9:00 am

Drawing on December 9, 2022 at 9:00 am

Phase 04: The Final

from December 9, 2022 at 9:00 am to December 16, 2022 at 9:00 am

6. Within 48 hours of the applicable Drawing Date, attempts will be made to reach the selected entrants via message on Instagram. If a selected entrant fails to respond after two attempts within five consecutive days of the first attempt to contact the selected entrant, his/her entry will be disqualified and the selected entrant will not win any prize. An alternate entrant will be selected. This process will continue until a winner is declared or there are no more eligible entries from which to choose.

General Terms and Conditions

7. Online entries must be made with the original, manual keystrokes of the particular entrant. The use of any mechanical, software or robotic assistance is strictly prohibited.

In the event of a dispute regarding the identity of the person who submitted the online entry, the entry will be deemed to have been submitted by the authorized account holder of the email address provided in the entry. “Authorized Account Holder” defines the natural person who is assigned an Instagram account.

To be declared a winner and to claim a prize, the entrant must:

(a) be reached by message, telephone or e-mail by the Contest judges within the time period specified above

(b) correctly answer a mathematical skill-testing question without mechanical assistance of any kind within the time frame specified by the contest judges during a telephone conversation with the selected entrant

(c) be eligible under these Contest Rules;

(d) sign a liability and publicity release (the “Release”) which will be mailed, couriered or emailed to the selected entrant who must then deliver the completed Release to the Contest judges by the date indicated on the Release.

8. Failure to comply with the above conditions or otherwise comply with these Contest Rules will result in disqualification of the selected entrant and that entrant will not receive a prize. In such event, and at the sole discretion of the Sponsor, a new random draw may be conducted from the remaining valid entries received in accordance with these Contest Rules until a winner is declared or there are no more valid entries to choose from. If, as a result of an error in the entry process, the draw or any other aspect of this Contest, there are more potential prize winners than contemplated by the Contest Rules, a random draw will be held from all eligible prize claimants at the end of the Contest Period to award the prize.

9. By entering this Contest, selected entrants allow the Sponsor and its representatives to communicate directly with them.

10. The Contest and these Contest Rules shall be governed by and construed exclusively in accordance with the laws of Quebec. Any dispute arising out of the Contest will be governed by the laws of Quebec.

11. By entering this Contest, entrants accept these Contest Rules and agree to be bound by them and by the decisions of the Sponsor and the Contest judges, which are final, binding and conclusive in all matters relating to this Contest.

12. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

13.The public can obtain the names of the contest winners by writing to [email protected] by December 23, 2022.

14. By entering this Contest, each entrant allows the Sponsor, its agencies, promotional agencies, representatives, contest judges and the Sponsor’s subsidiaries and affiliates to collect the information submitted with the entrant’s entry and use it to manage the Contest. If an entrant so indicates, the Sponsor, its subsidiaries and affiliates may contact the entrant in a variety of ways, including by telephone, computer or mail using the contact information provided by the entrant, to alert the entrant to products or services that may be of interest to him/her. Sponsor will respect entrant’s choices as otherwise indicated and entrant may opt-out at any time.
